Terms of Service

Last updated: September 23, 2026
Before You Begin
Romily is made to be used, and these Terms set out the ground rules for doing so. They cover the Romily mobile app, our websites, and the software, content and services we make available through them — together called the "Services".
Take the time to read them before you start.
Where this document says "Romily", "we", "us" or "our", it means the developer who designed and built the app. "Device" covers whatever you use to reach the Services — a phone, a tablet, a computer, or anything comparable. "You" is the person using the Services.
Creating an account, or simply using or accessing the Services, means you accept these Terms and agree to keep to them and to the laws, rules and regulations that apply where you are. Should you not accept them, the Services are not for you, and you should not use them.
Write to us at sparking321.game@gmail.com. That address takes every kind of correspondence — questions about the Services, questions about these Terms, or anything else you want to raise.
PLEASE READ THIS NOTICE. AN ARBITRATION CLAUSE FORMS PART OF THESE TERMS. SAVE FOR THE CATEGORIES OF DISPUTE THAT CLAUSE CARVES OUT, YOU AND ROMILY AGREE THAT ANY DISPUTE ARISING FROM THESE TERMS OR FROM YOUR USE OF THE SERVICES WILL BE SETTLED THROUGH MANDATORY BINDING ARBITRATION. BOTH YOU AND ROMILY ALSO GIVE UP ANY RIGHT TO BRING OR TAKE PART IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
1. Use of the Services
1.1 Changes we may make
We may change the Services, or withdraw them in whole or in part, either for a period or for good. Notice is not something we undertake to give. Neither you nor anyone else has a claim against us on account of a change, a suspension or a withdrawal.
1.2 Usage limits and storage
Rules and ceilings around the Services are ours to set. They may cover, among other things, how long data or other content stays on the Services and how much server storage is set aside for you. We accept no responsibility and no liability where data or other content kept on, or uploaded through, the Services is deleted or simply fails to be stored. Accounts left inactive for a long stretch may be closed. The rules and ceilings we set can be altered whenever we choose, at our discretion and without telling you first.
2. Mobile Use
2.1 Reaching the Services from a phone or tablet
A good deal of the Services can be reached from a mobile device. That covers uploading content from such a device, browsing the Services and our website on one, and reaching particular features through an app you have downloaded and installed — all of this, the "Mobile Services". When you reach the Services this way, your carrier's usual charges, data rates and other fees still apply.
2.2 Carrier restrictions
Your carrier may also forbid or limit the download, installation or use of particular Mobile Services, and not every Mobile Service will work on every network or handset. Using the Mobile Services means you accept that we may contact your device by SMS, MMS, text message or another electronic route about Romily and about other entities, and that some details of how you use the Mobile Services may be passed back to us.
2.3 Keeping your number current
Should your mobile number change or be given up, update your Romily account details without delay. Otherwise messages meant for you may reach whoever takes the number over.
3. Rules of Conduct
3.1 What you are responsible for
Whatever you put onto the Services — code, video, images, information, data, text, software, music, sound, photographs, graphics, messages or other material, all of which we call "content" — is your responsibility and yours alone, whether you upload, post, publish, display, email or otherwise use it through the Services. Set out below are illustrations of the content and the behaviour that Romily treats as illegal or off-limits. Where we judge, in our discretion, that someone has broken this rule, we may look into it and take whatever legal steps we think fit: removing the content, suspending or closing the account, and reporting the matter to law enforcement among them.
3.2 Prohibited conduct
You agree that you will not put the Services to any of these uses:
send by email or otherwise place on the Services any content that: (i) steps on another party's intellectual property or other proprietary rights; (ii) you are not entitled to place there, whether by law, contract or a relationship of trust; (iii) carries software viruses, or any other computer code, file or program built to interrupt, destroy or curtail the working of computer software, hardware or telecommunications equipment; (iv) puts anybody's privacy or security at risk; (v) amounts to advertising, promotional material, commercial activity or sales that nobody asked for — "junk mail", "spam", "chain letters", "pyramid schemes", "contests", "sweepstakes" and every other species of solicitation included; (vi) is unlawful, harmful, threatening, abusive, harassing, tortious, excessively violent, defamatory, vulgar, obscene, pornographic, libellous, an invasion of another's privacy, or hateful on racial, ethnic or other grounds; or (vii) Romily alone judges to be objectionable, or to hold other people back from using or enjoying the Services, or to risk harm or liability of any sort to Romily or to its users;
obstruct, overload or otherwise interfere with the Services, or with the servers and networks they depend on, or disregard the rules, procedures, policies or regulations those networks impose;
break any law or regulation having the force of law that applies locally, nationally or internationally;
pass yourself off as another person or organisation, or misstate whatever connection you have with one;
try to obtain personal information from anyone who has not yet turned 18;
gather or harvest the email addresses or other contact details of other users from the Services, by electronic or any other means, in order to send them emails or other communications they did not ask for;
promote goods or services, or hold yourself out as ready to trade in them, for a business purpose nobody has expressly authorised;
back criminal activity or enterprise, or teach others how to break the law;
come by, or try to come by, any material or information by means the Services do not deliberately provide.
3.3 Personal use only
Your own personal use is the only use the Services are meant for. Except where these Terms or the Services themselves clearly permit otherwise, you agree not to display, distribute, license, perform, publish, copy, reproduce, duplicate, modify, build derivative works from, sell, resell, exploit, transfer or commercially upload any part of the Services, any use of the Services, or any access to the Services.
3.4 Minimum age
The Services are not open to anyone who has not yet turned 18, with or without an account.
4. Intellectual Property
4.1 What Romily owns
Copyright, patent, trademark, trade secret and other proprietary rights and laws may protect the content or features held on the Services (the "Service Content"). Absent Romily’s express permission, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or build derivative works on the Services or on the Service Content, in whole or in part. That restriction does not reach your own User Content (a term explained below) which you lawfully place on the Services. While using the Services you must not set to work any data mining, robots, scraping or similar means of gathering or extracting data. Where Romily has blocked you from the Services — by blocking your IP address, for instance — you agree not to put any measure in place to get around that block, whether by masking your IP address or by using a proxy. Any use of the Services or the Service Content beyond what is specifically authorised here is strictly forbidden. The technology and software behind the Services, or distributed alongside them, belong to Romily, our affiliates and our partners (the "Software"). You agree not to copy it, modify it, build a derivative work from it, reverse engineer or reverse assemble it, or otherwise try to uncover its source code, nor to sell, assign, sublicense or otherwise transfer any right in it. Anything not expressly granted in these Terms stays with Romily.
The Romily name and logos are Romily's trademarks and service marks (the "Romily Marks"). Other company, product and service names and logos that appear through the Services may belong to their own owners, who may or may not endorse Romily or be connected with it. Nothing in these Terms or in the Services should be read as giving you, by implication, estoppel or otherwise, any licence or right to use a Romily Mark shown on the Services; our written permission is needed on each occasion. All goodwill arising from use of the Romily Marks accrues to us alone.
4.2 Third-party material
Content or material belonging to third parties — users among them — is never our responsibility, and we accept no liability for it. That covers errors and omissions in such content, and any loss or damage of any kind that follows from using it. You accept that Romily does not screen content in advance, though Romily and those it appoints keep the right (not the duty), acting in their discretion, to refuse or take down anything made available through the Services. Without limiting that, Romily and those it appoints may remove content that breaches these Terms, or that Romily alone considers otherwise objectionable. You agree that judging any content — and carrying the risks of relying on its accuracy, completeness or usefulness — falls to you.
4.3 Your content and the licence you grant us
As for the content or other material you place on the Services, or share with other users or recipients (together, "User Content"), you confirm and promise that the right, title and interest in it — all copyrights and rights of publicity included — are yours. By placing User Content on the Services you grant, and will continue to grant, Romily and its affiliated companies a licence that is non-exclusive, worldwide, royalty-free, fully paid up, transferable, sublicensable, perpetual and irrevocable, allowing them to copy, display, upload, perform, distribute, store, modify and otherwise use that User Content as part of running the Services or promoting, advertising or marketing them, in any form, medium or technology known now or devised later.
4.4 Feedback and submissions
Anything you pass to Romily in the way of questions, comments, suggestions, ideas, feedback or other information about the Services ("Submissions") is not confidential. Romily may use and circulate those Submissions without restriction, for commercial ends or otherwise, owing you neither acknowledgement nor payment.
4.5 Preserving and disclosing content
Romily may keep content, and may also disclose it where the law requires, or where we honestly believe keeping or disclosing it is reasonably called for in order to: (a) meet legal process, applicable laws or government requests; (b) enforce these Terms; (c) answer claims that content infringes somebody else's rights; or (d) protect the rights, property or personal safety of Romily, our users and the public. Bear in mind that the technical work of running and transmitting the Services, your content included, may entail (a) carriage across various networks; and (b) alterations made to suit the technical requirements of the networks or devices involved.
4.6 Copyright complaints
Romily values other people's intellectual property, and expects the same from those who use the Services. Should you believe your work has been copied in a manner amounting to copyright infringement, or that your intellectual property rights have been infringed in some other way, tell Romily using the procedure below.
Notices of alleged infringement are looked into, and whatever action the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws call for will be taken, whether the infringement is alleged or actual.
A notification only counts if it is made in writing and sets out all of these:
the signature of whoever may act for the owner of the copyright or other intellectual property interest — electronic or handwritten;
enough to identify the work, or other intellectual property, you believe has been infringed;
where on the Services the material you say infringes can be found, described closely enough for us to track it down;
where you can be reached: a postal address, a telephone number and an email address;
a statement that, in good faith, you believe the disputed use carries no authorisation — from the owner of the copyright or intellectual property, from that owner's agent, or from the law;
a statement under penalty of perjury that what your notice says is accurate, and that the copyright or intellectual property is yours or you act for its owner.
4.7 Counter-notices
Where User Content of yours has been taken down, or access to it disabled, and you consider that it does not infringe — or that the owner of the copyright, the owner's agent, or the law allows you to use and place it — you may write a counter-notice to the Copyright Agent setting out each of the following:
your signature, whether handwritten or electronic;
which content was taken down or disabled, and where it sat before that happened;
a statement that, in good faith, you believe the takedown or disabling came about by mistake, or through the wrong content being identified;
your name and the details on which you can be reached — a postal address, a telephone number and an email address; your consent to the jurisdiction of the federal court that sits in the State of Delaware; and your undertaking to accept service of process from the party that gave notice of the alleged infringement.
On receiving a counter-notice, the Copyright Agent passes a copy to the party who complained, telling them that the content may be put back, or no longer disabled, after 10 business days. Unless the copyright owner brings an action seeking a court order against the content provider, member or user, the content may be restored, or access to it reopened, 10 to 14 business days or longer after the counter-notice arrives — the decision being ours.
4.8 Repeat infringers
As the DMCA and other applicable law require, Romily's policy is to close the accounts of users judged to be repeat infringers, where the circumstances warrant it and at Romily's discretion. Romily may likewise, at its discretion, restrict access to the Services or end the membership of any user who infringes another's intellectual property rights, whether or not that infringement has been repeated.
5. Links to Other Sites
Links or other routes to other sites and resources on the internet may be offered by the Services, or by third parties. Those sites and resources lie beyond our control; we are not answerable for them, and their presence is no endorsement. You further accept that Romily is not responsible or liable, whether directly or indirectly, for any damage or loss caused, or said to be caused, by or in connection with using or relying on any content, event, goods or service found at or through such a site or resource. Whatever dealings you have with third parties you meet while using the Services are a matter between you and them; Romily is not liable for any loss or claim you may have against such a third party.
6. Warranties, and Where Our Liability Ends
6.1 No warranties
THE RISK OF USING THE SERVICES LIES ENTIRELY WITH YOU. THE SERVICES ARE SUPPLIED ON AN "AS IS" AND "AS AVAILABLE" FOOTING. ROMILY DISCLAIMS, EXPRESSLY, EVERY WARRANTY OF ANY KIND — EXPRESS, IMPLIED OR STATUTORY — THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AMONG THEM.
NO PROMISE IS MADE BY ROMILY ON ANY OF THESE POINTS: (I) THAT YOUR REQUIREMENTS WILL BE ANSWERED BY THE SERVICES; (II) THAT OPERATION WILL BE UNINTERRUPTED, PROMPT, SECURE AND ERROR-FREE; (III) THAT WHAT YOU OBTAIN FROM USING THE SERVICES WILL PROVE ACCURATE OR RELIABLE; OR (IV) THAT ANY PRODUCT, SERVICE, INFORMATION OR OTHER MATERIAL BOUGHT OR OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.
6.2 The ceiling on our liability
ROMILY IS NOT LIABLE FOR DAMAGES, AND YOU EXPRESSLY ACCEPT THIS, WHERE THE DAMAGES FALL INTO THE INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY CATEGORIES, NOR WHERE THEY ARE DAMAGES FOR LOST PROFITS — LOSS OF GOODWILL, LOSS OF USE, LOSS OF DATA AND OTHER INTANGIBLE LOSSES BEING COUNTED AMONG THOSE. THAT HOLDS EVEN IF ROMILY HAS BEEN WARNED SUCH DAMAGES MIGHT ARISE, AND WHATEVER FOOTING THE CLAIM RESTS ON — CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER. THE MATTERS COVERED ARE: (I) USING, OR BEING UNABLE TO USE, THE SERVICES; (II) THE COST OF SUBSTITUTE GOODS OR SERVICES FOLLOWING GOODS, DATA, INFORMATION OR SERVICES BOUGHT OR OBTAINED, MESSAGES RECEIVED, OR TRANSACTIONS ENTERED INTO, THROUGH OR FROM THE SERVICES; (III) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES; OR (V) ANY OTHER MATTER CONNECTED WITH THE SERVICES. ROMILY'S TOTAL LIABILITY TO YOU, ACROSS EVERY DAMAGE, LOSS AND CAUSE OF ACTION, WILL NEVER EXCEED THE SUM YOU HAVE PAID ROMILY IN THE LAST SIX (6) MONTHS OR, WHERE THAT SUM IS LOWER, ONE HUNDRED DOLLARS ($100).
6.3 Where these limits may not apply
SOME JURISDICTIONS DO NOT PERMIT THE DISCLAIMING OR EXCLUDING OF CERTAIN WARRANTIES, OR THE LIMITING OR EXCLUDING OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. WHERE THAT IS SO, SOME OF THE LIMITS DESCRIBED ABOVE MAY NOT APPLY TO YOU, OR MAY NOT BE ENFORCEABLE AGAINST YOU. IF ANY PART OF THE SERVICES, OR OF THESE TERMS, LEAVES YOU DISSATISFIED, DISCONTINUING YOUR USE OF THE SERVICES IS YOUR ONLY REMEDY.
6.4 New Jersey residents
IF YOU ARE A USER FROM NEW JERSEY: THE SECTIONS ABOVE HEADED "NO WARRANTIES" AND "THE CEILING ON OUR LIABILITY" ARE MEANT TO REACH ONLY AS FAR AS THE LAWS OF THE STATE OF NEW JERSEY PERMIT. SHOULD ANY PART OF THOSE SECTIONS BE HELD INVALID UNDER NEW JERSEY LAW, THAT PART'S INVALIDITY WILL NOT DISTURB THE VALIDITY OF THE REST.
7. When Accounts End
7.1 Our right to suspend or close an account
Romily may, acting in its discretion, suspend or close your account (or any part of it) or your use of the Services, and delete or discard any content held within the Services, for whatever reason — including inactivity, or where Romily considers that you have broken these Terms or acted against their letter or their spirit. Suspected fraud, abuse or illegal activity of a kind that could justify ending your use of the Services may be referred to the appropriate law enforcement authorities. Romily may also, at its discretion and at any moment, stop providing the Services or any part of them, with or without notice.
7.2 What happens when access ends
Access may be cut off under any provision of these Terms without prior warning. Romily may immediately deactivate or delete your account, and all the information and files within it, and bar any further access to those files or to the Services. Romily bears no liability to you or to any third party for ending your access to the Services.
8. The Whole Agreement
Between you and Romily, these Terms stand as the complete agreement. They govern your use of the Services and displace anything agreed earlier on the same subject. Other terms and conditions may separately bind you when you make use of affiliate or third-party services, third-party content or third-party software.
9. Your Privacy
Romily respects the privacy of the people who use it. Our Privacy Policy sets out the detail, and using the Services means consenting to the collection and use of personal data as that policy describes. How younger users are protected is dealt with separately in our Child Safety Policy.
10. How to Contact Us
To report a breach of these Terms, or to ask about them or about the Services, write to sparking321.game@gmail.com.
